WASHINGTON, DC (September 29, 2023) – On September 28, the NAI commented on Sen. Bill Cassidy’s (R-LA) Request for Information (RFI) on Improving Americans’ Health Data Privacy. The comments highlight three key recommendations: (1) Congress should emphasize the importance of data-driven health advertising for consumers and healthcare professionals, benefiting from improved access to medical treatments, discounts, and clinical trial viability. (2) Congress should pass a comprehensive consumer privacy law, focusing on preventing harmful outcomes and preventing broad limitations on access to health information, rather than expanding HIPAA’s scope. (3) A national privacy law should clearly define sensitive health information, distinguish non-sensitive and sensitive uses, and focus on all harmful uses of this information, regardless of sensitivity.
